ACKNOWLEDGMENT OF RISK AND WAIVER OF LIABILITY
By purchasing a PIT Pass Ticket ("Ticket") for [Event Name], taking place on [Date(s)] at [Location], ("Event"), I acknowledge and agree to the following terms:
Risks: I understand that participating in or being present in the PIT area of a dirt track race involves inherent risks, including but not limited to the risk of physical injury, property damage, and other risks associated with motor racing events. I voluntarily assume all risks, known and unknown, arising from my attendance at the Event.
Waiver and Release: I hereby release, waive, and discharge [Event Organizer's Name], its affiliates, officers, employees, agents, and volunteers ("Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in or observing the Event, whether caused by the negligence of the Releasees or otherwise.
Indemnification: I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs they may incur due to my presence in or around the PIT area, whether caused by my negligence or otherwise.
Health and Safety: I agree to comply with all rules, regulations, and instructions of the Event organizers, including wearing recommended safety gear and following all posted signage and verbal instructions. I acknowledge that failure to follow these guidelines may result in expulsion from the Event without refund.
Consent to Medical Treatment: I hereby give my consent for emergency medical treatment in case of injury or illness during the Event. I agree to be financially responsible for any medical bills incurred as a result of emergency treatment.
Age Confirmation: I confirm that I am of legal age and have the right to enter into this agreement. If the Ticket holder is a minor, this agreement must be co-signed by a parent or legal guardian who acknowledges and agrees to all terms herein.
Photo/Video Release: I understand that public events are often recorded and hereby give my permission for my likeness to be used in Event promotional materials or any other purpose by [Event Organizer] without payment or any other consideration.
This agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any dispute arising under this agreement shall be resolved in the courts of [Jurisdiction].
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND AGREE TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
